Common Documents Used to Open a Probate Case
When someone dies, their estate may need to go through probate, which is the legal process of handling their property and debts. To begin a probate case, the person asking the court to open the case (called the petitioner) must file certain documents with the probate court.
Common documents include:
Petition for Probate (Form PC 559): Starts the probate case and asks the court to appoint a personal representative.
Death Certificate: Proves the person has died.
Will and Codicils (if any): Shows the court how the person wanted their property to be handled.
Testimony to Identify Heirs (Form PC 565): Lists the legal heirs of the deceased.
Notice of Hearing (Form PC 562): Tells interested persons when the court will review the petition.
These documents help the court decide how to move forward and who should manage the estate.
